When ordering products from This is Art Studio, by designer Justine Coquidé, the following terms and conditions apply. This means that, as a customer, you accept and approve these General Conditions in all purchases on www.thisisart.fr

Among other things, This is Art complies with current provisions regarding consumer rights and European data protection and privacy law, the General Data Protection Regulation (GDPR).

 

Delivery

This is Art currently makes all shipments via DHL. We use different delivery options to deliver to you as quickly as possible. If we are not sure of the delivery time for your particular product, you can always contact our customer service (contact section). In the event of any delay in delivery, you will be informed of the reason for the delay and we will give you a new delivery time. If you do not accept the new delivery time, you must cancel the purchase.

 

Delivery to a post office / relay point

For obvious reasons, most of our products do not fit into a normal mailbox and are therefore sent directly to the nearest collection point (often a grocery store or a convenience store). Tracking is provided for all of our shipments. The scope of monitoring may vary from one delivery option to another. When your goods are available to be collected, you will receive an SMS containing the tracking number on the mobile phone number you specified when ordering. A valid ID must be presented when you collect your goods.

 

Delivery risk

This is Art assumes the risk that the products will be damaged or lost during transport from our studio to you. In the event of any return, you yourself assume the risk that the goods are damaged or lost;

 

Disclaimer regarding changes

We publish a disclaimer regarding any price changes, liquidations, printing errors, errors in product images and / or inaccurate information caused by technical or human error. We reserve the right to make changes in prices and purchase conditions.

 

Return policy

Dear Sam grants you the right to a withdrawal period of 15 days from the date on which you receive your products.

In the event of returns, the products must be returned in the same condition as that in which they were when they were delivered to you. The products must be returned in the original packaging of This is Art, with any accessories.

In order to verify that the products coincide with your order, you can only handle and inspect the products in the same way as you normally do if you try / look at products in a store. In case you have manipulated the products to a greater extent than that described above, you may have to pay the reduction in value of the products. This is Art studio applies a full reduction in value (ie the total value of the products) if the returned products are not in a condition to be resold (like new products)

In the event of return of goods, This is Art pays the return costs provided that you have first contacted our customer service via the contact section and followed our instructions regarding returns in Questions & Answers.

You, the customer, bear the transport risk yourself in the event of a return. This is Art declines all responsibility for any damage or loss during the transport of the returned goods. We therefore strongly recommend that you follow our instructions for returning the goods in their original packaging. The packaging of This is Art is designed to reduce the risk of damage during transport.

 

Refund of returns

In the case of a return received, approved, we reimburse, within 10 days, all payments that we have received from you including all delivery costs (from us to you). Refunds in the case of invoice payments are made to the personal account specified in the first request. In the case of a payment card, the money is returned to the card (i.e. to the account linked to the card) with which you made the purchase.

 

Right to claim

This is Art gives full compensation in the form of a new product when a manufacturing defect has been verified. It is important to carefully inspect the product when it arrives. If a product is damaged or defective when it arrives, a complaint must be made (if possible) within 7 days of receipt. Legislation and jurisdiction

If a dispute arises between you and This is Art Studio, we strongly encourage you to first contact us directly to seek a solution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to the dispute.

When you order products from This is Art, French law will apply.

When you order This is Art products, any dispute or claim arising outside of or in connection with your order (including non-contractual disputes or claims) must be resolved for a court located in France.

Any dispute or complaint with This is Art Studio (including non-contractual disputes or complaints) will be subject to the exclusive jurisdiction of the courts of France.

 

Confidentiality & security

All personal data takes place in accordance with the Data Protection Regulation (also known as GDPR within the framework of the General European Data Protection Regulation). This is Art works with Stripe, a leading global payment provider, to always guarantee secure payments. Stripe will collect all personal information related to payment. Stripe is therefore personally responsible for this personal data under the Stripe conditions.

 

By accepting the General Conditions of This is Art at the time of purchase, you agree that your information will be stored in order to process your order and complete the purchase, facilitate future purchases and allow the status of your order to be update.

 

This is Art will share personal data with its transport partners as well as its third party logistics suppliers in order to complete and deliver your order.

When, as a customer, you choose to send us an email, your email address and your email history will be saved to allow tracking and correspondence in a certain case.

We only keep personal information for as long as it is necessary, it will then be deleted. If the information is incomplete, incorrect or irrelevant, you can request that the information be corrected or deleted. You can also withdraw your consent to obtain offers at any time.

Age limit to order

Campaigns

Examples of circumstances beyond the studio's control include, but are not limited to, professional disputes, power outages, lightning strikes, fire, atmospheric disturbances, enactment of law, measures adopted by public authorities, acts of war, sandstone or circumstances similar, any power failure, interruptions in the premises of the persons responsible for the hosting / servers of the website where This is Art is located and / or delays due to networks connected to the internet, etc.
